PROMOTION DESCRIPTION: The $10,000 Sweepstakes begins on or about February 18, 2008 at 12:01 a.m. Central Standard Time (“CST”) and ends on September 15, 2008 at 11:59 p.m. Central Daylight Time (“CDT”) (the “Promotion Period”). At the end of the Promotion Period, a drawing will be conducted to select a winner of a Grand Prize of $10,000 as set forth more fully below. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these
Official Rules and the decisions of Fingerhut Direct Marking, Inc. (“Sponsor”), which shall be final and binding in all respects.
ELIGIBILITY: Only legal residents of the fifty (50) United States (and the District of Columbia) located in the United States at the time of entry who are eighteen (18) years of age or older are eligible to enter. VOID WHERE PROHIBITED. Officers, directors, and employees (and immediate family members and those persons living in the same household of any such officers, directors and employees) of Sponsor, and each of their respective parent companies, subsidiaries, affiliates, distributors, retailers, sales representatives, and advertising and promotion agencies, and any other person associated with the Sweepstakes (collectively, the “Promotion Entities”) are ineligible to enter the Sweepstakes or win a prize.
HOW TO ENTER: You may enter to win by placing an order via telephone or by placing an order at www.fingerhut.com, or without purchase by mailing an entry form according to the entry directions found in these Rules. Entry for the Sweepstakes will be automatic with an order placed via the telephone order line or the Sponsor’s website. If you prefer not to enter the Sweepstakes when placing an order, you may opt out of the Sweepstakes by placing your order via the mail. Deadline dates and other qualifiers for prize eligibility are specified in these Rules. To enter by mail, entry forms must be returned by First Class Mail and postmarked by the stated deadline for the Sweepstakes. This Sweepstakes is under the supervision of an independent judging agency whose decisions are final. Eligibility is based solely on receipt of completed entry and compliance with these Rules. For mail entries without a purchase, hand print your name, address, customer number (if you have one) and prize code (found at the bottom of these rules) on a 3" x 5" card and mail it to: 2008 - $10,000 Fingerhut Sweepstakes Entry, P.O. Box 0210, St Cloud, MN 56395-0210. If any part of the entry is mechanically reproduced, the entry will be disqualified. Limit of one entry per outer mailing envelope.
WINNER NOTIFICATION: The winner will be randomly selected from all eligible entries received throughout the Promotion Period. The random drawing is currently scheduled to be conducted on or about September 22, 2008 by Sponsor, using methods within its sole discretion. The potential winner will be notified by telephone and/or mail and/or email. Sponsor will attempt to contact potential winners using the e-mail address and other contact information provided by the entrant at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. If, despite reasonable efforts, a potential winner does not respond within five (5) days of the first notification attempt, or if the prize or prize notification is returned as declined, unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected
PRIZE/ODDS: One (“1”) Grand Prize of $10,000. Odds of winning depend on the number of
eligible entries received during the Promotion Period. Prize will be delivered only to an address
in the United States.
GENERAL PRIZE CONDITIONS: Each prize winner shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize. Potential winner may be required to execute an Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity Release (collectively, “Prize Claim Documents”). If a winner fails or refuses to sign and return all Prize Claim Documents within seven (7) days of prize notification, the winner may be disqualified and an alternate winner may be selected.
GENERAL RELEASE: Entrants agree that the Promotion Entities shall not be responsible or liable for any losses, damages or injuries (including death) of any kind resulting, in whole or in part, directly or indirectly, from participation in the Sweepstakes or in any Sweepstakes related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, or from typographical error in the printing, offering, or announcement of a prize Sponsor assumes no responsibility for any damage to an entrant’s computer system which is occasioned by accessing the Website or participating in the Sweepstakes or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, non-delivered, or postage-due submissions or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsman-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software generated or other automated multiple entries will be accepted. Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winners in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination.
GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS
AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE SWEEPSTAKES SHALL
BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE
OF MINNESOTA.
